Privacy Policy
This Privacy Policy sets out the way in which IMH, acting as data controller, collects, processes and uses the personal data that you, as a User of the website https://india-mahdavi.com/ (hereinafter, the “Site”), provide to IMH.
This Privacy Policy is intended to enable Users to know, even before they access the various sections of the Site and communicate their personal data, how IMH processes the personal data of Users of the Site. The User must read this Privacy Policy before submitting personal data.
1. Data controller
1.1. The data controller is IMH, a limited liability company with a capital of €55,000 registered in the Paris Trade and Companies Register under number 420 991 457, whose registered office is located at 3 Rue Las Cases 75007 Paris – France, represented by its manager, Mrs India Mahdavi (hereinafter “IMH”).
IMH is free to choose any individual or legal entity that processes Users’ personal data at its request and on its behalf (hereinafter a “subcontractor”), in particular to enable the provision of services requested by a User: technical services, payment services, transport, identity verification etc. IMH undertakes to select subcontractors offering sufficient guarantees regarding the technical and organisational security measures for the processing of personal data. IMH ensures that appropriate contractual provisions guarantee that its subcontractors will only use personal data for the purpose specified by IMH and in accordance with the objectives defined in this Privacy Policy.
1.2 IMH – and/or its subcontractors acting in its name and on its behalf – determines the purposes, technical and legal means of processing personal data and undertakes to take all the necessary organisational measures to guarantee secure processing that complies with the applicable regulations, in particular with Law No. 78-17 relating to information technology, files and freedoms of 6 January 1978 in its current version and with Regulation (EU) 2016/679 of 27 April 2016, the so-called General Data Protection Regulation “GDPR”.
2. Processing of personal data
The use of the Site, access to some of its sections and/or any request for information or services from Users of the Site may result in the communication of personal data.
The processing of such personal data will be carried out mainly by automated means and will be used for the purposes set out in point 5 below. IMH takes appropriate measures to ensure that the personal data of Users is processed lawfully, securely and confidentially, and to prevent the loss, misuse, alteration and deletion of such personal data.
3. Personal data that may be collected and processed
Information submitted by Users when filling in forms or creating a Customer Account on the Site is collected and processed by IMH. This information may include Users’ name, address, e-mail address, telephone number and payment information.
IMH also collects certain personal data about the User’s connection (IP address, geographical area, day and time of consultation, services consulted and/or used, etc.) and the device from which the connection is made.
4. Cookies
In order to better satisfy the needs of Users, to personalise the content of the Site according to their browsing and to correct any errors on the Site, the Site uses cookies relating to the User’s connection and browsing on the Site.
The purpose of the cookie is to indicate your visit to the Site.
Cookies are also used to measure the audience of the Website and for statistical purposes on behalf of IMH only.
The User can set his browser to know when a cookie will be activated. This allows the User to reject the use of the cookie or to ask the browser to delete the cookie at the end of his visit to the Site. The Site’s online shop cannot be used if cookies are rejected by the User’s browser.
In accordance with the applicable regulations, before placing or reading a cookie on a User’s computer, IMH :

– indicates to Users the means of refusing cookies.
In accordance with the recommendations of the CNIL, the User’s information and consent are provided by means of a visible banner on the Site, as well as by the present Privacy Policy.
Certain cookies that are strictly necessary for the provision of an online service expressly requested by the User or that aim to allow or facilitate the transmission of communication by electronic means, do not require the prior consent of Users, such as
– cookies that retain the choice expressed by Users on the deposit of cookies;
– cookies intended for authentication with a service, including those intended to ensure the security of the authentication mechanism, for example by limiting robotic or unexpected access attempts
– Tracers intended to keep track of the contents of a shopping cart on a merchant site or to invoice the user for the product(s) and/or service(s) purchased;
– Tracers for personalising the user interface (for example, for the choice of language or the presentation of a service), when such personalisation constitutes an intrinsic and expected element of the service;

5. Purposes of processing personal data
5.1. Users’ personal data is processed to enable the processing and delivery of orders placed on the Site.
Any failure, partial or inaccurate information on personal data marked with an asterisk, and therefore necessary for the execution of the requested service, will render the latter impossible. On the other hand, any lack of, partial or inaccurate information on optional personal data is without consequence.
The ordering process on the www.indiamahdavi.com website requires the creation of a Customer Account in which the User’s information is stored and protected by a password chosen by the User.
5.2. Subject to the User’s prior consent, the User’s personal data may also be used by IMH for commercial prospecting purposes, such as sending newsletters or promotional offers.
However, such consent will not be required, in accordance with the applicable regulations, if the User is already a customer of IMH and the canvassing concerns products or services similar to those already provided by IMH to the User.
6. Users’ rights and how to exercise them
The User has the right to access, rectify or delete his/her personal data, the right to limit the processing of his/her data, the right to portability and the right to object to the processing of his/her personal data, within the limits provided for by the regulations in force.
The User also has the right to withdraw his consent to the processing of his personal data at any time. Withdrawal of consent does not affect the lawfulness of the processing already carried out, based on the consent given prior to such withdrawal.

This correspondence must be accompanied by a copy of both sides of your identity card.
If you feel that your rights have not been respected, you have the right, independently of any recourse in the context of an administrative or judicial procedure, to lodge a complaint with one of the competent supervisory authorities. In France, the competent authority is the Commission Nationale de l’Informatique et des libertés (CNIL).
7. Duration of retention of personal data
In accordance with the legal requirements imposed by the applicable regulations, IMH keeps Users’ personal data only for as long as is reasonably necessary to fulfil the purposes for which they are processed.
8. Limitation of liability of the data controller
The Website may contain hyperlinks to websites controlled and operated by third parties not related to IMH. Where applicable, IMH cannot be held responsible for the content of these sites, nor for the personal data protection practices of these third parties. IMH cannot be held responsible for loss, corruption of data or identity theft, which may be caused by, but not limited to, viruses or computer attacks.
9. Changes to the Privacy Policy
IMH reserves the right to modify this Privacy Policy at any time in order to comply with applicable regulations or in order to adapt it to its practices and their evolution. Therefore, the User is invited to consult this Privacy Policy regularly in order to be aware of any changes and adaptations.
